What is administrative and environmental law?

Administrative law is about the rules the government – such as the State, Provinces, Municipalities, Water Boards and other government bodies – must follow when making decisions. Environmental law is a large part of it. Administrative and environmental law include the rules surrounding government decisions that affect the living environment such as permits, spatial planning and environmental regulations. Administrative law

We advise entrepreneurs, institutions and individuals on whether government decisions meet the requirements set by administrative law. This may involve, for example, obtaining permissions such as permits, waivers and exemptions. It may also involve enforcement decisions, which relate to the undoing of violations such as administrative enforcement and penalty orders, specific closure orders, and the imposition of administrative fines. Decisions may also involve obtaining financial resources such as grant decisions and compensation.

Where necessary, we enter into consultations for clients with authorities to achieve solutions for obtaining consents, resolving or legalizing violations, and obtaining financial resources.

Administrative procedural law

Administrative procedural law is part of administrative law and provides specific rules applicable to litigating against government decisions. We conduct public participation, opinion and objection procedures against government decisions for clients. We also conduct (higher) appeal proceedings for clients at the administrative courts of the district courts, the Board of Appeal and the Administrative Law Division of the Council of State (‘Raad van State’).

Environmental law

Environmental law is a broad and complex area of administrative law that provides rules about the physical environment. It relates to spatial planning, environment and nature, area development, and land exploitation. The rules in this area are always changing; we are aware of the most current rules and can therefore advise you optimally.
We advise entrepreneurs, institutions and individuals in the field of environmental law. Examples are zoning plans, obtaining environmental permits for the use of land, and construction activities. In the field of environmental and nature protection law, we advise on regulations that apply in the field of noise, odour and (fine) dust, soil pollution, groundwater pollution, air and water.

Compensation for planning damage

The adoption of a zoning plan or the granting of an environmental permit by the government may result in damages, which may be eligible for compensation. This may involve loss of income or property, for example reduction in the value of real estate. We advise you on whether the government is obliged to pay you compensation for planning damage.

Environmental law enforcement

The government enforces compliance with the rules of environmental law. They may issue enforcement decisions, such as administrative enforcement orders and penalty payment orders. If you have to deal with these, we can advise on them and conduct administrative law proceedings on your behalf.

Environment Act

As environmental law is constantly evolving, we are aware of its latest developments. A good example is the Environment Act, which has been in force since January 1st, 2024. This brings about major changes in the current laws and regulations in the field of environmental law. Our lawyers are thoroughly familiar with this and can therefore optimally advise you.
