This is how we can help you

We assist our clients in the field of financial law. We help you find your way through the maze of laws and regulations that threaten you as an entrepreneur, or that threaten your business. For example, we can assist you to:

  • advise in disputes with financial institutions regarding breach of duty of care or incorrect advice on financial products;
  • conduct foreclosure proceedings in summary proceedings to stop the foreclosure sale of your business premises or home by the mortgage holder;
  • advise on issues relating to the Financial Supervision Act (Wft);
  • assist with debt forgiveness and repayment through, for example, (extrajudicial) debt restructuring;
  • conduct Kifid (Financial Services Complaints Institute) proceedings to recover damages from financial institutions – breach of duty of care (over-indebtedness), termination of financing and banking relationship in the case of investment services (asset management, investment advice, execution only);
  • provide in the field of contract law and liability;
  • assisting in Kifid proceedings for removal of registration in the Incident Warning System;
  • conduct legal proceedings (such as summary proceedings) to remove negative BKR (Bureau for Credit Registrations) registrations;
  • advise and assisting in answering questions from the KYC/CDD department of financial institutions;
  • support in Wwft investigations regarding (unusual) transactions on business bank accounts;
  • advise to prevent bank fraud in business transactions.

Financial Supervision Act

We also advise entrepreneurs with questions they have about the Financial Supervision Act (Wft). For example, we can assist you with investigating whether your business and/or financing activities may be subject to licensing, or whether they are exempt from it. Based on this, you will know whether you need to apply for a license from the AFM (Authority for Financial Markets) or DNB (De Nederlandse Bank, the national Dutch Bank) (or both) – of course, we can guide you in this as well.

Contract law and liability

We advise clients in conducting contract negotiations, recording agreements in (international) contract documentation (including general terms and conditions), performing contract management and terminating agreements. We also assist in legal proceedings concerning the interpretation or non-performance of a contract.

Furthermore, we advise entrepreneurs when it comes to liabilities such as tort, improper administration, mismanagement, product liability and employer liability.
